These Terms of Service ("Terms") are a legal agreement between you and Outworked ("Outworked," "we," "us," or "our") governing your access to and use of the Outworked website, mobile web app, and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to create an account or use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information (including your display name and username) and to notify us promptly at support@outworked.app if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms, are inactive for an extended period, or are created with false information.
Outworked is a social accountability tool that lets you and people you invite create private challenges, set fitness and lifestyle goals, check in on those goals, and see how you compare to each other. Outworked is not a medical, fitness, nutrition, or health-monitoring service, and nothing on the Service is medical advice.
Assumption of risk.Physical activity carries inherent risk. You are solely responsible for determining whether an activity is appropriate for your health and physical condition, and we strongly encourage you to consult a physician before starting any new exercise, diet, or fitness program. You assume all risk of injury, illness, or other harm arising from your participation in any challenge or activity connected to the Service, including activity undertaken to compete with other users or avoid a negative in-app consequence (such as a "roast" message, streak loss, or leaderboard rank).
Challenges, goals, points, streaks, rewards, and penalties are created by you and other users of the Service, not by Outworked. We are not a party to and do not enforce any real-world reward or penalty (financial or otherwise) that a challenge's members agree to among themselves, and we are not responsible for whether members honor those arrangements. Points, streaks, and rankings within the Service have no cash value and cannot be redeemed, sold, or transferred.
The Service lets you submit photos, notes, reactions, votes, and other content ("User Content") as proof of completing a goal or otherwise interacting with a challenge. You retain ownership of your User Content. By submitting it, you grant Outworked and the other active members of any challenge you belong to a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content within the Service for the purpose of operating the challenge features (for example, showing your check-in photo in the group feed).
You represent that you own or have the necessary rights to any User Content you submit, and that it does not violate any law or infringe any third party's rights. Do not upload content depicting anyone other than yourself without their permission, and do not upload content depicting a minor.
Some User Content (such as check-in photos, when you request an AI-generated reaction) may be sent to a third-party AI provider for processing. See our Privacy Policy for details.
You agree not to use the Service to:
We may remove content, cap or reverse points, or suspend or terminate an account that violates this section, at our discretion and without prior notice.
If you believe content on the Service infringes your copyright, send a written notice to support@outworked.app identifying the copyrighted work, the material you claim is infringing and its location on the Service, your contact information, and a statement that you have a good-faith belief the use is not authorized. We will remove infringing content we identify and may terminate the accounts of repeat infringers.
The Service relies on third-party providers to operate, including hosting and database infrastructure, transactional email delivery, and AI-generated text and image analysis. We are not responsible for outages or failures caused by those providers, though we will work to restore the Service promptly.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTWORKED AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold Outworked harmless from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of your User Content, your use of the Service, or your violation of these Terms.
You and Outworked agree to first try to resolve any dispute informally by contacting support@outworked.app. If a dispute is not resolved within 30 days, you and Outworked agree that it will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. You and Outworked each waive any right to a jury trial or to participate in a class action. This section does not apply if prohibited by the law of your jurisdiction.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except where superseded by federal arbitration law.
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you in the app. Continuing to use the Service after a change takes effect means you accept the updated Terms.
